Hagerstown man found GUILTY of 2021 sexual assault, domestic battery in Martinsburg

03 May 2024- Berkeley County Prosecuting Attorney Catie Wilkes Delligatti announces that on May 2, 2024 a Berkeley County jury found DUSTIN ALBERT CAREY, 35, of Hagerstown, Maryland, guilty of two counts of the felony offense of Sexual Abuse in the First Degree, two counts of the felony offense of Sexual Assault in the Second Degree, and five counts of the misdemeanor offense of Domestic Battery arising from a rape that occurred on June 13, 2021, at 1620 Winchester Avenue.

Carey now faces a maximum sentence of twenty-four and a half years to sixty years (24.5–60) years in prison, fifty (50) years of supervised release thereafter, and $42,500 in fines. Carey will also be required to register as a sex offender for the remainder of his life.

Upon the return of the jury’s verdicts, the Defendant was remanded to custody to await sentencing. A sentencing hearing is scheduled for June 21, 2024, at 3:00 p.m. The three-day trial was held before the Honorable Judge Michael D. Lorensen of the 23rd Judicial Circuit.
