Fulton Co. Trooper arrested for DUI during shift, had BAC nearly double legal limit

27 November 2023- A trooper with the Pennsylvania State has been charged with Driving Under the Influence while operating a police cruiser on his shift. Justin Andrew Dibert is free awaiting arraignment after being charged with misdemeanor DUI/unsafe driving, misdemeanor DUI with a BAC between .10 and .16%, and summary careless driving.

Around 5:30pm on Monday, November 20th, the PSP shift supervisor for PSP Chambersburg was called to assist with an ongoing incident at 500 Fulton Drive in McConnellsburg. That location, it should be noted, is PSP-McConnellsburg’s barracks just outside the borough.

When the outside Trooper arrived, they spoke to one of PSP-McConnellsburg’s corporals who explained that an intoxicated man was driving his 2019 Ford Explorer. That man was determined to be Justin Dibert, a PSP Trooper from Bedford who worked at the McConnellsburg station.

Officers had conducted various field sobriety tests on Dibert, including a breathalyzer, prior to the outside Trooper being called in to assist. After the tests and breathalyzer showed Dibert was likely inebriated and had alcohol on his breath, more officers were brought in to assist.

Troopers say that Trooper Dibert had a moderate odor of alcohol coming from him, as well as having glossy and bloodshot eyes. A legal blood draw was conducted on Dibert about an hour and a half after Troopers were initially alerted to him potentially being drunk. Blood testing later found Dibert still had a BAC of .153% after that extended period of time.

Justin Dibert is free awaiting a December 19th arraignment by MDJ David Washabaugh V in McConnellsburg.
