Court documents released following Shippensburg man being charged with sexual assault of his foster child

16 November 2023- In documents now released to the public, a Shippensburg man is allegedly shown to have sexually assaulted and threatened a 17 year old girl in his care as a foster child. Marshall Clyde Mixell is charged with felony unlawful contact with a minor, felony aggravated indecent assault, felony aggravated indecent assault without consent, felony child endangerment, felony corruption of minors, misdemeanor indecent assault without consent, and misdemeanor indecent assault forcible compulsion. Mixell is free on an unsecured bail of $125,000.

In early August of 2023, Pennsylvania State Police in Carlisle received a Childline report of potential abuse of a 17 year old female in Southampton Township, Cumberland County. In the report, it was allegedly disclosed that the victim’s foster father, Marshall Mixell, had done sexual things to her in the laundry room of their home while he was caring for her.

Marshall’s wife was interviewed shortly after, with her reportedly saying that as soon as Marshall Mixell realized the victim had been removed from the home for her protection, he packed a bag and left. Mixell’s wife reportedly received a text message of him leaving, with him saying someone happed in the laundry room with her coming “onto me and asked about the washer and I went to explain to her about the washer and she said shut the door and wasn’t thinking about it. And she came onto me. I had a moment and kissed her”.

Police were able to access security camera footage of the home during the incident but of the outside of the room. It reportedly shows the victim and Mixell entering and exiting in a 12 minute time frame around midnight on 6/24 and 6/25.

The victim was forensically interviewed, with her describing the incident in detail. During the interview, police say the victim said she refused Mixell’s advances but he continued. After this incident, the victim tried to go to bed and Mixell reportedly asked to give her a back rub. During the incident, court papers show the victim believed Mixell was drunk. Shortly after, however, Mixell reportedly told the victim that he would hurt and kill his wife (the victim’s foster mother) and family if she told anyone.

Mixell was interviewed by police about the incident shortly after the forensic interview of the victim. During that interview, police say Mixell told them he was approached by the victim, with her asking how to use the washing machine. He admitted they then went into the laundry room, but with Mixell allegedly denying anything else happened inside. No mention of time of day was recorded in court filings by PSP.

Marshall Mixell is free on an unsecured bail of $125,000. His preliminary hearing is set for November 28th.
