26 January 2024- A Waynesboro man is facing multiple felonies after being accused of providing the drugs that killed another borough man last year. Dustin Lynn Weaver is charged with felony drug delivery resulting in death, felony delivery of a controlled substance, and felony criminal use of a communications facility. Weaver failed to post bail of $250,000 bail.
Waynesboro PD officers were originally dispatched to a home on W Main Street in the Borough around 2pm on September 7th, 2023, for a reported overdose. Officers then found the victim on the third floor of a home and the Franklin County Coroner’s office was called for.
WPD officers say that they found the man laying on the floor just inside his bedroom door with needles, drug paraphernalia, and empty caps around the scene. Additionally, the victim’s cell phone was recovered by police.
After interviews with the victim’s girlfriend, WPD learned that the victim may have been in contact with someone named Doug or Duff prior to his death. An investigation of the phone found on scene eventually yielded a contact for Duff. Executing a search warrant on AT&T for the number, police learned that the number was associated with Dustin Weaver.
Additional details about the victim’s relationship with Weaver were established through the interview with the prior’s girlfriend. This included known spots they met and what kind of vehicle Weaver drove. Weaver, WPD investigators say, was previously known to them for him selling controlled substances in the Waynesboro area.
In the days after the OD death, police were able to find security camera footage from a business nearby to where the victim met Weaver the night prior to his death. Police say that security camera footage seemed to show a drug deal being conducted, with the victim and Weaver positively identified.
An autopsy was conducted on the victim, with results making clear that his death was an overdose. The official report listed the victim’s cause of death as “mixed toxicity effects of multiple drugs to include fentanyl and dilated cardiomyopathy from chronic drug use”.
After the investigation yielded the security camera footage as well as texts between the victim and Weaver on where to meet up, Weaver was charged in the prior’s death.
Dustin Lynn Weaver is behind bars on $250,000 bail. His preliminary hearing is set for January 30th.
